Transboundary environmental impact assessment

According to the Ministry of Environmental Protection and Natural Resources of Ukraine, the Government has approved the Procedure for making decisions on transboundary environmental impact assessment.

Previously, there was no detailed Procedure, which led to some ambiguous interpretations during the implementation of such a procedure. At the same time, for conducting full-fledged research, which is the basis for such decisions, high-quality environmental laboratory services are necessary, allowing to obtain accurate data on environmental impact.

From now on, the document contains the following mechanism:

▪️ provides for the involvement of the Ministry of Environmental Protection, the authorized territorial body, and the Interdepartmental Coordination Council in making decisions on transboundary EIA;

▪️ the assessment of transboundary environmental impact is carried out by decision of the Ministry of Environmental Protection based on information on planned activities or an appeal from a foreign state, taking into account international requirements;

▪️ when considering and determining possible significant negative transboundary environmental impact, the scale of the planned activity, its location, and possible consequences are taken into account.

 The draft resolution was developed to ensure the proper implementation of Article 14 of the Law of Ukraine "On Environmental Impact Assessment" regarding the assessment of transboundary environmental impact.
